Terms of Service

1. Acceptance

By installing the "MaxVision TikTok Suite" Claude Code plugin, by paying for a Pro / Shop+ / Agency subscription on Stripe, or by calling the hosted MCP server at tiktok-mcp.produtoramaxvision.com.br, you accept these Terms. If you do not accept, do not use the Service.

2. Who we are

"Service" means the Claude Code plugin tiktok-maxvision, the MCP server, the License Worker, the Landing site, and any related material. "MaxVision," "we," or "our" means Produtora MaxVision, Brazil. Contact: produtoramaxvision@gmail.com.

3. Eligibility

You must be at least 18 years old and able to enter binding contracts. You must own or be authorized to act on behalf of any TikTok / TikTok Shop / TikTok Business account you connect through OAuth.

4. License

Free tier plugin source: AGPL-3.0. Pro / Shop+ / Agency tier components and the hosted MCP server are proprietary; access is licensed, not sold, conditional on paid subscription and these Terms.

5. Acceptable use

You agree NOT to:

Violate TikTok's Terms of Service, Community Guidelines, Developer Terms, Shop Partner Agreement, or Business API Terms.
Operate fake or impersonating accounts, engage in coordinated inauthentic behavior, buy/sell engagement, or use the Service for spam.
Scrape data outside the rate limits and scopes we publish, or reverse-engineer the Service.
Resell, sublicense, or white-label the Service except as allowed by the Agency tier.
Use the Service to harass, threaten, harm, or process data of users without lawful basis.
Bypass the license server, share API keys across customers, or share Pro features through unauthorized accounts.

6. Plans, billing, trials

Free tier: $0, rate-limited.
Pro: $39/month or $390/year. 7-day free trial.
Shop+: $79/month or $790/year. 7-day free trial.
Agency: $199/month or $1,990/year. 7-day free trial.
Subscriptions renew automatically until canceled. You can cancel any time through Stripe Customer Portal; access continues until the end of the paid period.
Refunds: pro-rated only when required by Brazilian Consumer Law (CDC) or EU consumer rights. Otherwise no refunds.
Quota overages: hard cap by default. Soft cap available on request (Shop+ / Agency).

7. OAuth, third parties, your data

OAuth scopes are granted by you on TikTok's consent screens. You can revoke at any time at tiktok.com/setting/connected-apps. We process data per the Privacy Policy. We do not act as TikTok or as a TikTok partner: we are an independent client of TikTok APIs.

8. Service availability

Best-effort uptime. Planned maintenance windows are announced via email or landing banner. Agency tier carries SLA of best-effort 24h response, NOT guaranteed uptime SLA. No credit issued for outages caused by upstream TikTok, Apify, Bright Data, Cloudflare, Stripe, or force majeure.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE EXPLICITLY DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TIKTOK MAY CHANGE ITS APIs, RATE LIMITS, OR POLICIES WITHOUT NOTICE; YOUR USE OF THE SERVICE IS AT YOUR OWN RISK INCLUDING RISK OF ACCOUNT SUSPENSION BY TIKTOK FOR REASONS WITHIN OR OUTSIDE OUR CONTROL.

10. Limitation of liability

To the maximum extent permitted by law, MaxVision's aggregate liability is capped at the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages including lost profits, lost data, or business interruption.

11. Indemnity

You will indemnify MaxVision against claims arising from your violation of these Terms, of TikTok's policies, or of applicable law.

12. Termination

You may cancel anytime. We may suspend or terminate access immediately for violations of Section 5, fraud, chargebacks, or non-payment. On termination we delete personal data per the Privacy Policy retention rules.

13. Governing law and venue

Brazilian law. Venue: courts of São Paulo, SP, Brazil. EU consumers retain rights under their local consumer law and may file claims in their habitual residence.

14. Changes

We may update these Terms; material changes notified by email at least 15 days in advance. Continued use after the effective date constitutes acceptance.
